Patent Preparation and Prosecution

L&P specializes in drafting and prosecuting patent applications for high-value inventions for which “good enough” is just not good enough.  The firm is especially adept at continuation and, when necessary, reissue practice to obtain claims that cover later-arising commercial embodiments of a patent’s disclosure.  L&P is well suited to prosecute patent families whose members are the subject of litigation or post-grant proceedings.

L&P’s prosecution practices go beyond the widely accepted “best practices,” some of which, although still widely popular, are no longer sensible in in today’s post-America-Invents-Act (AIA) environment, in which the first page of every accused infringer’s playbook is an invalidation proceeding at the PTAB, rather than a summary judgment of non-infringement.  Old-fashioned approaches to patent drafting and prosecution can be counter-productive in today’s PTAB-dominated patent litigation landscape.  L&P leverages its expertise and deep experience in PTAB post-grant proceedings to draft and prosecute patents that will survive PTAB challenges.

L&P attorneys have received the highest ratings from large clients who rate and rank their many outside prosecution firms, including some of the largest and best known patent firms.  Numerous publications that assess patent attorneys based on client interviews and peer reviews consistently provide L&P attorneys with top rankings and praise for our skills and reputations.
